1. Service Description

The AI Employee service includes the setup and ongoing support of one or more AI-powered tools, such as a Voice AI receptionist, chatbot, and/or email bot, intended to help business owners manage customer support, appointment booking, FAQs, and general client communication.

This is a monthly subscription service that includes:

• Custom setup (one-time fee)

• Ongoing software access

• Technical updates

• Customer support

2. Eligibility & Geographic Scope

This Service is intended for business owners based in the United States and is designed to support a single business location. Businesses operating multiple locations must request a custom solution by contacting us at [email protected]

3. Subscription & Payment Terms

• Setup Fee: A one-time setup fee is required to initiate the service.

• Monthly Subscription Fee: Recurring payments will be charged monthly, covering software access, updates, and support.

• Payment Methods: Payments are processed via Stripe, which accepts major credit/debit cards. We also accept cash or check for customers local to Gray, GA.

All payments are non-refundable. You acknowledge that by purchasing this Service, you are committing to the agreed fees regardless of your usage level.

4. Fair Use Policy

This Service is offered under a "Fair Use" policy. While usage thresholds are generous, abuse of system resources—such as excessive call/chat volume, attempting to manage multiple businesses or locations under one subscription, or any behavior that negatively impacts service quality for others—may result in additional fees, account suspension, or termination.

We reserve the right to define and determine excessive use at our sole discretion and will notify you before taking any corrective action.

5. Prohibited Uses

To maintain compliance and ethical standards, you agree not to use the Service to:

• Send spam, unsolicited marketing, or phishing messages

• Engage in illegal, deceptive, or fraudulent activity

• Promote violence, hate speech, or adult content

• Handle or collect sensitive personal data (e.g., health, financial, or legal information) without proper disclosures and safeguards

• Use the AI Employee for more than one business or business location without authorization

• Attempt to reverse-engineer, resell, or sublicense the technology behind the Service

Violation of these restrictions may result in immediate termination of your subscription without refund.

6. Support & Service Availability

We provide reasonable support during standard business hours (Eastern Time, Monday–Friday). While we strive for high availability, we do not guarantee uninterrupted access and shall not be liable for downtime caused by technical issues, maintenance, or third-party providers.

7. Intellectual Property

All software, tools, content, and materials provided as part of this Service remain the sole property of Click Marshall Internet Marketing LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business use only.

8. Limitation of Liability

To the maximum extent permitted by law, Click Marshall Internet Marketing LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, data loss, or business interruption arising from the use or inability to use the Service.

Our total liability shall not exceed the amount paid by you in the previous 30 days preceding the claim.

9. Termination

You may cancel your subscription at any time by contacting us at [email protected]. Termination will take effect at the end of your current billing period. No refunds will be issued for partial months or unused services.

We reserve the right to suspend or terminate your access to the Service for violation of these Terms or misuse of the system.

10. Changes to Terms

We may update these Terms at any time. You will be notified of material changes via email or on our website. Continued use of the Service after such changes constitutes your acceptance of the new Terms.
